Reporting to the General Manager, you will promote best practices as you provide leadership in ensuring Canada Post compliance with the Access to Information Act and the federal Privacy Act. As Director, Privacy and Access to Information, you will oversee a team of legal and policy professionals and analysts in the development and implementation of corporate-wide policies, programs and practices to support regulatory compliance and to ensure that the Corporation’s obligations with regard to the above legislation are met. Along with providing expert advice and guidance to senior management and employees on the application and interpretation of the Acts, you will identify and develop mitigation strategies for privacy and data protection, and oversee the operational process associated with access to information and privacy requests – from intake to complaints and investigations.
This is an exciting opportunity to oversee the breach management, response and notification process as it relates to unauthorized disclosure of employee or customer personal information, and to play a lead advisory role in Canada Post’s management of breaches impacting privacy and the commercially-sensitive activities of the Corporation.
As Director of Privacy and Access to Information, you will:
- Establish the team’s priorities and plans, ensuring consistency with the GM`s strategic direction, monitor progress to plan, identify gaps and implement corrective action plans.
- Develop, implement and monitor the internal policies, procedures and practices for administering compliance to the Acts, including processing and tracking requests and ensuring adherence to legislative timelines.
- Regularly consult with senior managers, lines of business and Legal Affairs for the proper application of the legislation and corporate policies, and ensure that the Corporation’s annual reporting obligations as outlined in the Acts are met.
- Provide direction, advice, support and recommendations to various corporate functions whose records of information become the subject of ATI and Privacy requests.
- Influence, and negotiate with, various stakeholders on ATI and Privacy issues to determine relevance and materiality of information and disclosure obligations on a timely basis.
- Formulate and recommend options and strategies for Canada Post’s position on disputed Privacy and ATI cases that are under investigation, and collaborate with Legal Affairs and outside counsel to provide subject matter expertise in support of legal challenges and litigation.
- Liaise with the Offices of the Information Commissioner and Privacy Commissioner to keep abreast of any emerging issues, relevant jurisprudence or marketplace developments, identify ATI and Privacy risks to the Corporation, and make recommendations to senior management on appropriate courses of action.
- Research, analyze and evaluate major complaints and challenges filed with the Offices of the Information and Privacy Commissioners of Canada, and negotiate settlements and solutions with the parties concerned and/or offer recommendations to senior management on ATI and Privacy requests and related contentious ATI or Privacy issues.
- Monitor regulatory developments in the area of privacy and access to information, as well as develop and recommend positions and responses that take into consideration any threats to the Corporation’s business and data activities.
- Oversee Privacy Office preparation of privacy risk assessments and formal privacy impact assessments on current or future CPC products or services, and make recommendations to the appropriate business areas on courses of action and risk mitigation strategies.
- Oversee the design and development of Canada Post’s ATI and Privacy training and education program aimed at increasing the knowledge and awareness of all employees regarding their respective roles and responsibilities in exercising their responsibilities under the ATI and Privacy Acts.
- Develop and maintain a team of ATI and Privacy professionals with the appropriate skills and competencies to meet departmental objectives, and create a favourable organizational climate such that staff are motivated and committed to deliver to the best of their abilities, while demonstrating, maintaining and promoting a high level of professional and ethical standards.
You bring a successful track record to the role of Director, Privacy and Access to Information:
- A post-secondary degree (disciplines of Public Policy, Information Management, General Business and Marketing) or a Law degree
- At least 7 years of direct experience in the management of access to information and privacy programs in a large and complex organization
- Experience in managing complex issues in a fast-paced environment involving multiple internal and external stakeholders, including senior executives, unionized employees and regulators
- Hands-on experience in developing and implementing risk-based strategies in response to current and emerging issues in the areas of privacy, data and technology, and access to information
- Senior leadership experience in leading, managing and motivating a highly functional team
- Working knowledge of the Access to Information Act, the Privacy Act, relevant jurisprudence, Canadian and global standards and marketplace best practices and their application to Canada Post
- Excellent verbal and written communication skills, with particular proficiency in preparing written reports, strategic plans, briefing notes, etc.
- Proficiency in English, essential; bilingualism (French and English), an asset.
