To act as the organization’s key expert regarding privacy matters, promoting TransLink enterprise compliance with the protection of privacy requirements under the Freedom of Information and Protection of Privacy Act (FOIPPA).
Designs and oversees implementation of the enterprise-wide privacy program to foster a privacy-sensitive culture and proactively avoid breaches of FOIPPA. Develops policies and procedures necessary to ensure compliance. Maintains awareness of changes to legislation and industry best practices, and adapts policies and procedures accordingly.
Leads organizational review of protection of privacy practices, and also conducts audits across the enterprise to ensure compliance with privacy policies and procedures. Initiates action with business leaders to influence compliance, escalating issues to General Counsel & Corporate Secretary as required.
Chairs an enterprise-wide privacy working committee to establish the appropriate collection, use and disclosure of personal information in all practices and programs.
Participates as a member of internal project teams, with a view to proactively influencing and shaping the integration of privacy into emerging programs and technology. Leads the preparation of privacy impact assessments for projects involving the extensive collection of personal information.
Provides advice to senior management and the Board on issues related to protection of privacy, including significant or precedent-setting decisions made by the Office of the Information & Privacy Commissioner (OIPC) that could affect TransLink’s interpretation and application of the Act.
Liaises with the OIPC regarding formal privacy complaints, facilitating investigations, overseeing implementation of necessary changes through applicable business leader(s), and following through to ensure ongoing compliance. Also investigates internal privacy complaints, ensuring changes are implemented for compliance. Consults with legal counsel on complaints as required.
Represents TransLink to the Province on protection of privacy by advising legislative committees considering amendments to the Act, and also participating on ad hoc committees as required.
Acts as resident expert on privacy, providing advice, guidance and training to all levels of management on privacy policies, procedures and related issues.
Provides technical guidance to support role on the coordination of privacy-related administrative processes.
Education & Experience:
The requirements for this job are typically acquired through completion of a privacy-related certificate program, and 7 years of related experience (preferably a blend of private and public sector) or an equivalent combination of education and experience.
Advanced knowledge of the protection of privacy requirements under the Freedom of Information & Protection of Privacy (FOIPP) Act. Also solid knowledge of the information access requirements under the Act in order to provide backup for the Manager, Information Access.
Advanced ability to plan, develop, implement and monitor a sound privacy program, including related framework of policies and procedures to foster compliance with the FOIPP Act.
Solid communication and interpersonal skills to communicate with leaders at all levels in a compelling and clear manner, with ability to use strong persuasion skills.
Solid judgement and decision-making skills to establish appropriate protection of privacy practices in all practices and programs.
Solid analytical skills to conduct reviews, audits, investigations and impact assessments pertaining to protection of privacy in practices, programs and projects.
Solid leadership skills to act as resident expert on protection of privacy, and provide advice, guidance and training to all levels of management.
